Rental Terms

Effective 2025-03-22 · Last updated 2025-07-14

These terms are the agreement between Bradley Tractor Equipment Zone LLC (“Inventrios”, “we”) and the person or business renting equipment (“you”). A signed rental agreement or master rental agreement takes precedence where it differs. By accepting delivery of equipment you accept these terms.

1. Rental period and rates

The rental period starts when the equipment leaves our yard and ends when you call it off by email or phone to the office, or when you return it to the yard. Rates are as published on Pricing or on your quote: a day is 8 machine hours in 24 hours, a week 40 hours in 7 days, a 4-week period 160 hours in 28 days. Hours above the allowance, read from the hour meter, bill at the published overtime rate. A rental that runs past its period continues at the rate that produces the lowest charge. Minimum periods apply to certain machines as listed.

2. Charges

You pay the rental rate, delivery and pickup by zone, the damage waiver unless you provide insurance, fuel used, attachments, operator time if ordered, and applicable sales tax. There are no environmental, administrative or convenience fees. Rates may change with 30 days' notice on the pricing page; a change never applies inside a rental already on rent.

3. Payment

Card customers are charged at delivery for the quoted period and at return for the balance. Account customers are invoiced monthly, due net 30 days. Balances more than 15 days past due accrue interest at 1.5% per month or the maximum the law allows, whichever is less, and we may stop deliveries and pick up equipment on rent after notice. You pay our reasonable costs of collection.

4. Delivery, pickup and return

You provide a site the truck can reach and unload safely and a person to sign the condition report. Equipment is accepted in the condition shown on that report unless you tell us in writing within 24 hours. At the end of the rental, leave the equipment accessible where it was delivered, or where we agree in writing. We pick up within two business days of the off-rent call; days beyond that are not charged. Customer pickups and returns are at the yard during business hours, with a tow vehicle and trailer rated for the load.

5. Use of the equipment

You will use the equipment only with trained, licensed operators, within the manufacturer's manual and the law, at the site on the agreement, and not in water, on hazardous waste, or for anything the machine is not built for. You will check fluids daily, keep the equipment secured when not in use, and not alter it, remove decals or safety devices, or sublet it. Trucks that drive on public roads are operated by your drivers with the licenses the law requires.

6. Breakdowns and maintenance

We deliver equipment in good working order. Report a failure to the office immediately and stop using the machine. We repair or replace equipment that fails from normal wear at our cost, and the rental clock stops from your call until the replacement is running. Damage from misuse, neglect, overloading, running without fluids or operating outside the manual is repaired at your cost at our shop rates, documented with photos before the work starts.

7. Risk of loss, damage waiver and insurance

You are responsible for the equipment from delivery until we pick it up or you return it, including loss, theft, damage and vandalism, up to its replacement value, plus loss of rental during repair. The damage waiver, at 14% of the rental charge, limits what you owe for accidental damage to $2,500 per incident; it does not cover theft from an unsecured site, overturning, operation in water, misuse, tires or glass, or loss while in transit on your trailer. In place of the waiver you may provide a certificate of insurance naming BRADLEY TRACTOR EQUIPMENT ZONE LLC as loss payee and additional insured, with equipment physical damage coverage at replacement value and $1,000,000 general liability, before delivery.

8. Liability

You are responsible for injury, death and property damage arising from your use of the equipment, and will defend and indemnify us against claims from it, except to the extent caused by our negligence or by a defect we failed to repair after notice. Except for those obligations and for charges owed, neither side is liable to the other for indirect, consequential or lost-profit damages, and our total liability is limited to the charges on the rental concerned.

9. Title and recovery

The equipment stays our property. You will not let a lien attach to it. If you fail to pay, misuse the equipment or become insolvent, we may enter the site during business hours and remove the equipment, and you will pay the charges to the date of removal. Machines over 8 tons carry GPS tracking used for recovery and service.

10. General

California law governs this agreement; courts in Riverside County, California have jurisdiction. Neither side may assign the agreement without consent, except to a successor in a merger or sale. Notices go to the email on the account and to sales@inventrios.com. If a term is unenforceable, the rest stands. We may update these terms with 30 days' notice on this page and by email to account customers; rentals ordered after the date are under the new terms.
